The present bail application has been filed by the applicant in Case Crime No. 728 of 2016, u/s 498A, 304B IPC and 3/4 D.P. Act,P.S. Barkheda, District Pilibhit (S.T. No. 330/2016) with the prayer for enlarging him on bail.
Having heard Sri Atul Pandey, learned counsel for the applicant, learned AGA for the State and perused the statement made by the deceased. I find that the deceased died within one year of the marriage on account of smothering. The applicant is husband of the deceased and he has not offered any plausible and satisfactory explanation for the death of his wife inside his house, I do not find it to be a fit case for enlarging the applicant on bail.
The bail application is, accordingly, rejected.
However, it has been stated by the counsel for the applicant that five witnesses have been examined by the prosecution.
The trial court is directed to expedite the trial and conclude the same preferably within the period of four months from the date of production of the certified copy of this order before the trial court.
