Heard learned counsel for the applicant.
The applicant is before this Court for a direction to initiate contempt proceeding against the opposite party for disobedience of the interim order dated 30.9.2008 passed in Writ-A No.51804 of 2008 filed by the applicant, wherein the Court directed to the parties to maintain status quo on spot with regard to the property in suit till the next date of listing.
Nothing has been brought on record to indicate or suggest that the status quo order, which has been passed in Writ Petition No.51804 of 2008 is being flouted by the opposite party.
In the facts and circumstances, the Court is not inclined to proceed in the matter under Section 12 of the Contempt of Courts Act, 1971.
The application is totally misconceived and the same is accordingly dismissed.
However, this order would not come in the way of applicant to approach the appropriate forum for redressal of his grievance.
