Heard Mr.Ashish Dagli, learned counsel for the applicant, Mr.B.K. Raj, learned counsel for the respondent No.1 and Mr.H.L. Jani, learned Additional Public Prosecutor for the respondent No.2-State.
Mr.
Dagli, learned counsel for the applicant, states that the applicant is ready to deposit 50% of the compensation amount, awarded by the learned 3rd Additional Sessions, Judge, Vadodara, within reasonable time period, as may be directed by this Court. He has also contended that the applicant has already deposited an amount of Rs.40,000/- during the pendency of the appeal with the concerned Court.
In view of above, the applicant shall first deposit 50% of the compensation amount before the concerned Court on or before 13th February, 2012 and shall produce copy of receipt showing deposit of amount. The amount of Rs.40,000/-, which is already deposited with the Court, shall be adjusted. In the meantime, time to surrender is also extended upto 13th February, 2012.
