RULE.
Learned advocate Mr. Viral Vyas for Mr. Dagli, learned advocate for the applicant states that as directed by this Court, the applicant has deposited Rs.60,000/- before the concerned Court and earlier Rs.40,000/- has already been deposited. The applicant has deposited total amount of Rs.1 Lac before the concerned Court.
Learned advocate Mr. Raj for respondent No.1 states that the respondent No.1
- original complainant may be permitted to withdraw the said amount on suitable condition.
Learned advocate Mr. Vyas has no objection, if the complainant will withdraw the said amount on the condition of furnishing bank guarantee of the said amount.
I have perused the receipt showing the deposit of the amount of Rs.60,000/-, which is ordered to be taken on record. In view of the statements made by both the parties, the complainant is permitted to withdraw the amount of Rs.1,00,000/- upon furnishing the bank guarantee of the said amount. Time to surrender by the applicant is extended till further order. Direct service is permitted today.
