Ghanshyam Sharma vs Up Public Service Tribunal & ...

High Court Of Judicature at Allahabad|12 October, 2012

JUDGMENT / ORDER

The contention of the petitioner is that he has been appointed against the substantive post as a Junior Clerk. In the appointment letter, it is mentioned that the appointment is temporary and till the regular appointment is made. The appointment letter is Annexure-5 to the writ petition. The submission is that on a similar situation the Tribunal has allowed the claim of Ms. Sadhana Shukla but the petitioner claim has been illegally rejected though the petitioner also stands on similar footing.
Learned Standing Counsel states that he has filed counter affidavit on 27.7.1998. The same is not on record.
Office is directed to place the same on record and list the case in the next cause list. Learned Standing Counsel may also inquire whether the order of the Tribunal allowing the claim of Ms. Sadhana Shukla has been challenged or not.
