JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE JAYANT PATEL) The present application has been preferred by the applicant-convict for regularization of the period of 2 days for late surrendering after this Court released him on temporary bail on account of the operation of his mother.
This Court on 24.1.2012 had passed the following order.
"The jail authority shall convey to the convict, if he is desirous, to produce any medical papers for sickness of his mother, since during the said period, as stated by him, he was granted temporary bail also for sickness of his mother.
S.O.
to 14th February, 2012".
Thereafter, the medical papers are produced which are of the much earlier date than the date on which he surrendered late.
Upon further inquiry by the Court, learned APP under the instructions of the concerned Officer states that in such a case, if the matter is to be considered by the jail authority for imposition of punishment, normally, censure or warning is being given.
Under these circumstances, we need not further express the final view on the aspects as to whether medical paper meets with the requirement or not. Suffice it to state that the matter shall be considered appropriately by the jail authority for the lenient punishment as may be available in law.
Subject to the aforesaid observation, application is disposed of.
