The petitioner is the holder of building permit for constructing residential building. The petitioner wants to extract ordinary earth from the site covered by Ext.P1 permit.
2. In view of Ext.P2 Government Order, no permit is required for extracting ordinary earth. However, for transporting ordinary earth, 'P form' is necessary.
Accordingly, there shall be a direction to the third respondent to issue 'P form' on being satisfied with the genuineness of the claim of the petitioner based on Ext.P1 without insisting for No Objection Certificate within a period of ten days from the date of receipt of a copy of this judgment.
The writ petition is disposed of as above.
