JUDGMENT / ORDER

While issuing Rule vide order dated 10.05.2012, this Court has directed that the undisputed amount as referred to in the Affidavit at Page Nos.98-99 of the petition shall be paid to each of the workmen by Account Payee Cheques after proper verification. Pursuant thereto, the Registry had put up a Note dated 23.08.2012, indicating that respondent No.1 has filed an Affidavit dated 08.08.2012, supplying the complete and full names of each of the workman and the amount to which they are entitled. However, in the said Affidavit, the total amount is different from the amount indicated on Page Nos.98-99. By order dated 03.09.2012, this Court had directed the Registry to submit a detailed Note. Pursuant hereto, Registry has submitted Note dated 11.09.2012, wherein the discrepancies in the total amount shown at Page Nos.98-99 of the petition and in the Affidavit filed on 08.08.2012 have been indicated. Respondent No.1 has thereafter filed another Affidavit that has been notarized on 16.09.2012, wherein it is stated that there is a mistake in calculation and now the said respondent is claiming an amount of Rs.17,73,586/-. To this Affidavit, another statement has been annexed at Page Nos.105 and 106, showing the details of the amounts due to different workers, totalling to Rs.17,73,586/-.
As the petition is still pending and the order of this Court dated 10.05.2012 is very clear and specific, that the amount indicated at Page 98-99 shall be paid to each of the workmen by Account Payee Cheques, there is no requirement for the Registry to pay any other amount or for the learned advocate for respondent No.1 to advance any further calculations. No other amount except that indicated in the order dated 10.05.2012, is to be paid. The Registry shall comply with order dated 10.05.2012 and make the payment of the amount as indicated at Page Nos.98 and 99 of the petition, that is, the total amount of Rs.17,40,036/-, as agreed by Mr.T.R.Mishra, learned advocate for respondent No.1. The Note of the Registry stands disposed of.
The petition be listed for final hearing in its turn.
