Heard Ms. Patel, learned advocate for the applicant. The order dated 22.12.2011 is hereby reviewed.
It is clarified that amount of Rs. 1,08,455/- as directed vide order dated 22.12.2011 is not required to be deposited by the present applicant as payment of the same is the liability of the original opponent no. 2 - present respondent no. 6 which has already achieved finality.
The present applicant is required to deposit amount of Rs. 2,16,910/- which has already been deposited by the applicant and orders thereto have already been passed vide order dated 22.12.2011.
Therefore the order dated 22.12.2011 is hereby modified by clarifying that the present applicant is not required to deposit Rs. 1,08,455/-. Misc. Civil Application is allowed accordingly.
