Heard Ms Margret Garima, learned Advocate, holding for Mr. Ayank Mishra, learned counsel for the appellant and Mr. Surendra Nath Dubey, learned counsel for respondents.
The appellant pray for condoning the 193 days' delay caused in filing the special appeal. The respondents have not filed any reply opposing the prayer till today. In view thereof and for the reasons stated in the application and in the affidavit filed in support thereof, the delay in filing the special appeal is condoned. The application is disposed of.

Counsel for the appellant seeks permission to withdraw the special appeal with liberty to the appellant to take appropriate remedy against the order, impugned in the present appeal. The special appeal is disposed of as withdrawn.
