JUDGMENT / ORDER

The Hon’ble Sri Justice C.V.Nagarjuna Reddy Writ Petition No.37565 of 2014 Dated 06.12.2014 Between:
M/s.New Gene Agri Solution rep. by its Proprietor A.Balakrishna And The State of Andhra Pradesh, rep. by its Prl.Secretary, Agriculture Department, Hyderabad and another.
…Petitioner …Respondents Counsel for the petitioner: Mr.Dadi Radha Krishna Counsel for the respondents: AGP for Agriculture (AP)
The Court made the following:
Order:
This Writ Petition is filed for a Mandamus to declare the action of the respondents, in interfering with the petitioner’s business of marketing and supply of various bio-products mentioned in the prayer, as illegal, arbitrary and unconstitutional. A perusal of the record shows that except the Value Added Tax Registration Certificate, dated 01- 11-2014, and the purported unregistered lease deed, dated 17-11-2014, no material is filed by the petitioner to show that it has established a marketing unit and that it has been manufacturing the bio- products mentioned in the prayer. In the absence of any such material, this Court is not inclined to entertain the Writ Petition.
Accordingly, this Writ Petition is dismissed with liberty to the petitioner to file a fresh one with proper pleadings and the material in support of its plea that it has already established a unit and that the respondents have been unduly interfering with its business of sale and marketing of the bio-products.
As a sequel, WPMP.No.47002 of 2014, filed by the petitioner for interim relief, is disposed of as infructuous.
