Leave to join the Director General of Police, State of Gujarat, and the District Superintendent of Police, District Junagadh, at Junagadh, as party-respondent Nos. 4 and 5 in the present proceeding. Cause title to be amended forthwith.
Learned counsel for the petitioner submits that, in spite of a complaint having been sent by a Registered Post AD to the Police Inspector, Sola High Court Police Station, Ahmedabad, the complaint is not registered and it is the case of the petitioner-father that his daughter was forcibly taken by some person. In spite of efforts made by the petitioner by filing Special Criminal Application No.889 of 2011 seeking a writ of Habeas Corpus and the direction contained in the order dated 21.6.2011 to the concerned Investigating Officer to take action to trace out the daughter of the petitioner at the earliest keeping it open to the petitioner to approach the appropriate forum in the event if he has any grievance regarding slackness in the investigation, no efforts are made by the respondents and, therefore, the petitioner has invoked the jurisdiction of this Court under Article 226 of the Constitution of India for appropriate relief in the present petition.
If the daughter of the petitioner is not traced out by the respondents herein and a report is not submitted accordingly before this Court on or before 31.1.2012, appropriate orders in accordance with law will be passed against the respondents, directing them to remain present in the Court.
Issue notice returnable on 31.1.2012.
Learned APP waives service on behalf of the respondents.
Copy of this order be given to the learned APP for necessary compliance.
