Heard learned counsel for the petitioner, learned standing counsel for respondent Nos. 1 & 2 and Sri A.K. Yadav, learned counsel for respondent Nos. 3 & 4.
Learned counsel for the petitioner submits that petitioner appeared in Assistant Teacher Recruitment Examination, 2018. Result of petitioner was declared in which she has given 61 marks and declared not qualified and on the website, it was shown that "Result Not Found". He next submitted that petitioner has submitted an application to obtain photocopy of answer book after depositing Rs. 2,000/- as provided in Rule. It is further submitted that when she obtained scanned copy of the answer book after re-evaluation, she has been awarded 69 marks. It is next submitted that minimum qualifying marks for getting appointment is 67 marks, therefore, she has submitted application dated 15.07.2019 before respondent No. 4 for providing her appointment, but the same has not been decided. Lastly, it is submitted that a suitable direction may be issued to respondent No. 4 to decide the application of the petitioner and issue her appointment letter.
Learned standing counsel for respondent Nos. 1 & 2 as well as Sri A.K. Yadav, learned counsel for respondent Nos. 3 & 4 has no objection.
Considering the facts and circumstances of the case, the writ petition is disposed of with a direction to respondent no.4 to consider and decide the application of the petitioner dated 15.07.2019 strictly in accordance with law maximum within four weeks from the date of production of certified copy of this order. Petitioner is directed to annex photocopy of the application dated 15.07.2019 along with certified copy of this order.
It is made clear that Court has not adjudicated the case on merits and it is upon the respondent no.4 to decide the application of the petitioner after considering the Rules and Government Order occupying the field.
