Seetharama, Advocate for R2) This Writ Petition is filed under Articles 226 and 227 of the Constitution of India, praying to direct the R-1 to disburse the voluntary retirement benefits to the petitioner in accordance with law as per the order passed by the Hon’ble Metropolitan Traffic Court-I at Bangalore in C.Misc.No.132/2010 on 08.06.2011 as per Annexure-A order to transfer the said amount to the Hon’ble Court in C.Misc.No.132/2010 to claim the same in accordance with law and etc.
This Petition coming on for Orders, this day, the Court made the following:-
ORDER Sri. N. Sriram Reddy, learned counsel for petitioner.
Sri. Vijay Kumar A. Patil, learned AGA for respondent No.1.
Sri. Seetharama, learned counsel for respondent No.2 Petition is admitted for hearing. With the consent of the parties, it is heard finally.
2. Learned counsel for the petitioner and respondent No.2 have filed a joint memo stating that the dispute between them have been amicably settled. The terms and conditions of the amicable settlement have been spelled out in paragraph No.3 of the joint memo.
3. Learned counsel for the petitioner and respondent No.2 submits that they be granted liberty to present this joint memo before respondent No.1 and respondent No.1 be directed to take suitable action on the aforesaid joint memo and to make payment as agreed to between petitioner and respondent No.2 in accordance with law.
4. On the other hand, learned AGA submits that in case of such a joint memo is presented before respondent No.1, suitable action in accordance with law will be taken.
5. In view of the submissions made and in the facts of the case, writ petition is disposed of with liberty to the petitioner and respondent No.2 to present the joint memo before respondent No.1. On presentation of the said memo, respondent No.1 shall take suitable action on the aforesaid memo in accordance with law within a period of six weeks from the date of receipt of certified copy of the order passed today.
Accordingly, petition is disposed of.
