1. The applicant has taken out present application seeking below mentioned relief / direction:-

(B) As per the order passed in Civil Application No.654 of 2006, the aforementioned Special Civil Application No.12750 of 2004 may kindly be notified for final hearing at an early date in the interest of justice.

2. The Court (Coram: Hon'ble Mr. Justice D.H. Waghela) has already passed order dated 10.12.2009 in Civil Application No.13063 of 2009 which reads thus:-
"Application is disposed with the direction that the main SCA No.12750 of 2004 shall be listed for final hearing on 19.01.2010."
3. In view of the said order any further or fresh directions are not required, however office is directed to take necessary and appropriate steps for listing the matter i.e. SCA No.12750 of 2004 in the cause list for final hearing according to its seniority and also by taking into account the order dated 10.12.2009.
With the aforesaid clarifications the application stands disposed of accordingly.
