[1] RULE.
Shri Rushabh Shah, learned advocate waives service of notice of Rule on behalf of respondent No.1 as he has appeared in the main matter. Shri L.B. Dabhi, learned Additional Public Prosecutor waives service of notice of Rule on behalf of respondent No.2. In the facts and circumstances of the case and with the consent of learned advocates appearing for respective parties, present application is taken up for final hearing today.
[2] Present application has been preferred by the applicants herein - original petitioners for modification/correction of the order dated 03.08.2011 passed by this Court in Special Criminal Application No.928/2011 to the extent awarding maintenance to the petitioner No.1 wife at the rate of Rs.7,500/- per month instead of Rs.7,000/- per month as mentioned in the operative portion of the order in para 8 of the said order.
[3] Having heard the learned advocates appearing for respective parties and considering the earlier paragraph, infact this Court awarded a sum of Rs.7,500/- per month to the petitioner No.1 wife from June 2009 onwards and by mistake and/or through oversight, in para 8, Rs.7,000/- per month is mentioned.
[4] Under the circumstances, the order dated 03.08.2011 passed by this Court in Special Criminal Application No.928/2011 is modified to the extent that in para 8 of the said order, in place of Rs.7,000/- per month, it should be read as Rs.7,500/- per month. Registry is directed to issue fresh order accordingly. Rule is made absolute accordingly. Direct service is permitted.
