Heard learned counsel for the applicant and learned AGA appearing on behalf of the State.
This Application has been filed with a pryer to expedite and conclude the proceeding of Case No. 1321 of 2017 (Old Case No. 786 of 2016)'State vs. Pramod and others' Case Crime No. 622 of 2015, under Sections 498A, 323, 504, 506 IPC & Section 3/4 Dowry Prohibition Act, P.S. Civil Lines District Meerut pending before the learned Additional Chief Judicial Magistrate, Court No. 3, Meerut.
The submission is that this case is pending since the year 2016 and evidence of only one witness of fact has been recorded so far. A perusal of the order sheet shows that the proceedings of case are going on at a lethargic pace.
Looking to the aforesaid facts, learned trial court is directed to proceed with the trial expeditiously and conclude the same within a period of six months next in accordance with Section 309 Cr.P.C. and in view of principle laid down in the recent judgment of Hon'ble Supreme Court in the case of Vinod Kumar vs. State of Punjab reported in 2015 (3) SCC 220, if there is no legal impediment.
It is made clear that in case the witnesses are not appearing, the concerned court is directed to initiate necessary coercive measure for ensuring their presence.
Let a copy of the order be certified to the court concerned for necessary compliance.
