Heard Sri Shivendu Ojha, learned counsel for the petitioners and Sri Vikram Bahadur Yadav, learned Standing Counsel for the respondents.
Learned counsel for the parties submit that the writ petition be finally decided at this stage.
By means of this writ petition, the petitioners who are nine in number have been terminated from service of Aganwarikaryakartri in district Jhansi. Learned counsel for the petitioner submits that by the order dated 6.11.2017, their services have been terminated without affording any opportunity. It is further submitted that the government order dated 20.2.2013 mandates giving of opportunity before terminating the services of the petitioners.
Learned Standing Counsel was directed to seek instruction in the matter and upon instruction he admits that there is a requirement of giving a notice before terminating the services of the Aganwarikaryakartri as has been required under the government order dated 20.2.2013 and further no opportunity was given to the petitioners before terminating their services.
Accordingly, the order of termination cannot be sustained and it is hereby quashed with the direction to the appropriate authority that in case they want to proceed in the matter they can do so by following the prescribed procedure under law which in the present case has not been followed.
The writ petition to the aforesaid extent is allowed.
