Heard Mr. Raj Kumar, learned counsel for the petitioners and Mr. Abhishek Tiwari, learned Advocate, holding for Mr. Santosh Kumar Singh, learned counsel for respondents 4 and 5.
Having due regard to the nature of challenge raised in the instant writ petition, counsel for the petitioners has agreed for the order that we propose to pass. Counsel for the respondents- authorities also has agreed for such an order. Hence, we dispose of the writ petition by the following order:
The Executive Engineer of respondent no.4 shall visit the site on 20.6.2018 at 10:30 am to mark/indicate non-compoundable portion of the unauthorized construction made by petitioners. Counsel for the petitioners submits that the petitioners shall also remain present on 20.6.2018 at 10:30 in the morning. He further submits that the petitioners undertake to demolish non- compoundable portion of the structure within fifteen days thereafter, failing which, he submits that the petitioners will not have any objection for the respondents-development authority from demolishing the said portion immediately thereafter. His submission is recorded and accepted.
With these observations, the petition is disposed of.
