Heard learned counsel for parties.
Sri Saurabh Tiwari, learned counsel appearing for the Nagar Panchayat has placed on the record instructions which are marked as 'X' for the purpose of identification. From those instructions, it is pointed out that a sum of Rs.3,26,307.90 is liable to be paid to the petitioner towards retiral benefits. Out of the aforesaid sum, the Nagar Panchayat has released Rs.50,000/-. Sri Tiwari, learned counsel on instructions states that the balance amount which is admittedly due and payable, shall be released with expedition and in any case within a period of two months from today. The statement so made is recorded and accepted.
While dealing with the claim of the petitioner for release of the balance retiral benefits, the respondents shall also attend to her prayer for payment of interest on account of delayed disbursal bearing in mind the decision of the Court rendered in Yogendra Singh Vs. State of U.P. [(2017) 1 ALJ 121].
The writ petition shall stand disposed of accordingly.
