The present application under Section 482 Cr.P.C. has been filed for directing the learned Civil Judge (Junior Division), Kaushambi to take necessary steps to conclude the trial of Case No. 619 of 2017 (State Vs. Nathan Lal) arising out of Crime No. 421 of 2016 under Sections 325, 323, 504 and 506 I.P.C. Police Station Karari, District Kaushambi.
It is contended by the learned counsel for the applicant that accused is not appearing before court below yet no coercive steps have been taken by the learned court below which is resulting in delay of disposal of case.
Heard learned counsel for the applicant and learned A.G.A., perused the order-sheet.
The case was instituted on 29.07.2012 and, thereafter hardly four dates have been fixed in this case. Till date, due to absence of the accused, no charge could be framed.
In this view, this application is disposed of with a direction to the court below to make best efforts to decide this case expeditiously, if possible, within a period of one year.
