Heard Sri Bhavishya Sharma, learned counsel for the petitioner and Sri Manvendra Dixit, learned Standing Counsel for the respondent nos.1 and 2.
By means of this petition under Article 226 of the Constitution of India, the petitioner has prayed for relief in the nature of certiorari quashing the order dated 11.4.2019 whereby respondent no.3 has rejected the claim of the petitioner on the sole ground of being barred by time.
Learned counsel for the petitioner has drawn our attention to the letter of the Managing Director of the Insurance Project dated 21.8.2017 whereunder the power has been conferred upon the District Magistrate to relax further period of one month in matters of compensation that are covered under the scheme floated by the State Government in the name of Chief Minister, Life Insurance Scheme.
Learned Standing Counsel has no objection if the District Magistrate is directed to consider the claim of the petitioner as far as relaxation is concerned.
In such view of the matter, we hereby, dispose of this petition directing the Respondent No.2-District Magistrate to consider the relaxation qua the claim of the petitioner regarding insurance amount under the relevant scheme and pass an appropriate order within four weeks from the date of production of certified copy of this order.
