This writ petition has been filed seeking the following relief:-
" i) issue a writ, order or direction in the nature of Mandamus commanding to the respondent no.2 to take decision for approval of the proposal of Gram Panchayat/Land Management Committee in respect of allotment of residential land to the petitioner bearing plot No.198M area 0.012 Hectare, situated in Village Katari, Pargana Katehar, Tehsil and District Varanasi within some stipulated period as this Hon'ble Court deems fit and proper."
Sri Shailendra Kumar Singh, learned counsel for the petitioner, submits that the proceedings are pending before the Respondent No.2, Sub Divisional Magistrate, Tehsil-Sadar, District Varanasi, however, no final decision has been taken till date.
Learned Standing Counsel fairly states that in case the above- mentioned proceeding is pending and has not been decided till date, the same would be considered and decided expeditiously.
In view of the above, without expressing any opinion on the merits of the issue and considering the facts and circumstances of the case, this writ petition is disposed of finally with a direction to the concerned Sub Divisional Magistrate, to decide petitioner's aforesaid case and pass appropriate reasoned order expeditiously after affording opportunity of hearing to all concerned parties.
