Heard learned counsel for the applicant, learned AGA for the State and perused the record.
This application under Section 482 CrPC has been filed by the applicant with a prayer to direct the learned Additional Chief Judicial Magistrate, Court No.17, Allahabad to decide the Complaint Case No. 262 of 2019 (Smt. Geeta Devi Vs. Pradeep Kumar Mishra), under Section 138 of Negotiable Instruments Act, Police Station Cantt., District Allahabad within stipulated period.
Learned counsel for the applicant has submitted that applicant is the complainant in the present case and she has filed a complaint on 02.05.2019 and since then, proceeding has been lingering-on, on one pretext or the other.
In view of the provision of Section 143(3) of the Negotiable Instruments Act, learned court below is directed to make all endeavours to decide the aforesaid case as expeditiously as possible, preferably within a period of three months from the date of filing of certified copy of this order without giving any unnecessary adjournments to either parties, if there is no other legal impediment in deciding the aforesaid case.
With the aforesaid direction, this application under Section 482 CrPC is finally disposed of.
