Heard Shri Ajay Kumar Srivastava, learned counsel for the petitioner, learned standing counsel for the State-respondents and perused the record.
The present writ petition, under Article 226 of the Constitution, has been filed with the following prayer:-
"i). Issue a writ, order or direction in the nature mandamus directing to the respondent no.2 to expedite disposal of Case No.01201 of 2021 (Humraj Vs. Nand Lal), under Section 34 U.P. Land Revenue Code within a stipulated period in the interest of justice."
It is contended by the learned counsel for the petitioner that he filed an application on 03.06.2021 for mutating his name in the Revenue record on the basis of the sale-deed dated 05.05.2021 alleged to have been executed by Nand Lal, which remain pending till date.
The order-sheet of the case indicates that the time was granted to Nand Lal to file an objection, but no objection was filed. The order-sheet also indicates that the time as prescribed under Rule 34, Sub-section 7 of U.P. Revenue Code, 2006 i.e. six months to conclude the proceedings has not been expired till date and even otherwise the case was adjourned mostly due to the strike of lawyers, either due to non-availability of the Presiding Officers or due to Covid-19 Pandemic and there appears no inordinate delay in concluding the proceedings.
The petitioner filed the present writ petition on 30.11.2021, even without impleading the private persons as party.
The writ petition is totally misconceived and is dismissed, accordingly.
