Mr.
S.J.Trivedi, APFC, who has made the affidavit dated 8.2.2010 to remain personally present on the next date of hearing, i.e. on 13.2.2012. The said deponent shall come with the details to explain the position about the amount deposited by the contractors and/or the principal employer towards provident fund in respect of the concerned petitioner. The said deponent shall also explain the details of the actions taken in cases of default in depositing the amounts and as to whether timely actions were taken in cases of default and delay or not. The said deponent shall also explain the details about the examination of record of the principal employer and as to whether the principal employer has been complying with all statutory requirements in respect of its contractors/contract workers in accordance with the provisions of the Act.
Ms.
V.S.Pathak, learned AGP, shall ensure that the concerned Government Labour Officer or the Assistant Commissioner of Labour dealing with the unit of the respondent - principal employer so far as the provisions under the Contract Labour Act is concerned, also remains present at the time of hearing with all necessary details to explain the compliance regarding the provisions of Contract Labour Act, particularly with regard to maintenance of record, as per various Labour Legislations, including EPF Act and Factories Act.
