G.C.Immanuel vs Mr.Dr.V.P.Ramamurthi

Madras High Court|21 November, 2017

JUDGMENT / ORDER

When the contempt petition is taken up for hearing, the learned counsel appearing for the contemnor represented that a sum of Rs.79,485/- (Rupees seventy nine thousand four hundred and eighty five only) towards backwages has been paid to the petitioner as per the last drawn wages by way of Demand Draft No.414964 dated 20.11.2017. He would further submits that the contemnor is willing to take back the petitioner into work, pending the writ petition.
2. However, the learned counsel appearing for the petitioner submits that if the contemnor pays the current wages, the petitioner would join, provided a letter is given on that basis.
3. Considering the above, liberty is given to the contemnor to issue a letter asking the petitioner to rejoin on condition that the respondent would pay the current wages received by all other employees similarly placed. As and when, the same is received, the petitioner shall rejoin the respondent within a period of two weeks thereafter. Accordingly, the contempt petition stands closed.
