G.Barathi vs The General Manager

Madras High Court|19 January, 2017

JUDGMENT / ORDER

This writ petition has been filed by the petitioner challenging the show cause notice in No.M/C.79/CS/SMU-5/MAS, dated 03.01.2017 issued by the second respondent and to quash the same and also forbearing the respondents 1 & 2 terminating her license in respect of Catering Stall SMU-5, Chennai Central.
2.Heard the learned counsel for the petitioner and the learned counsel for the respondents.
3.The learned counsel for the petitioner would point out that the petitioner has made a request to the concerned authorities to give the translated copy of the said notice as she is not well versed in English language and she is not able to understand the content of the notice. But unfortunately, it is seen that the petitioner has been communicating the authorities concerned in English language, in her earlier letters in page 93 of the typed-set of papers dated 06.08.2016 and also, in respect of the very same matter, she has filed a detailed affidavit and had signed it in English. Even though the petitioner is not well versed in English, she can take the guidance of her eminent lawyers, for which, she has come to this Court with the present petition.
4.Therefore, this Court feels that her lawyer can always give explanation in regard to the notice, translate the content of it at this stage even if it is necessary and with their assistance, she can give a detailed reply to the show cause notice but however, only thing to be taken into account is that the period granted to give her reply has expired. In view the same, this Court grants two weeks time to the petitioner to give her reply to the said show cause notice from the date of receipt of a copy of this order.
5.With the above observations and directions, this Writ Petition is disposed of. Consequently, connected Miscellaneous Petitions are also closed. No costs.
