(Per : HONOURABLE THE ACTING CHIEF JUSTICE MR.BHASKAR BHATTACHARYA) After hearing the learned counsel for the parties and after going through the materials on record, we are of the view that for effective adjudication of the dispute involved in the main public interest litigation, the order dated July 1, 1984 passed by the Additional Mamlatdar & ALT Choryasi, Surat in Tenancy Case No.246 of 1984 and the record and proceedings relating to Entry No.670 dated July 7, 1981 in respect of the auction sale of land of Survey Nos.6 and 8 of Pandesara, District Surat are material. However, we find from the affidavit affirmed by the State-respondent that those are not available in the State record.
We direct the State-respondent to search out those record or to find out copy thereof either in the form of certified copy or from other sources. At any rate, the State-respondent is directed to produce the order dated July 1, 1984 passed by the Additional Mamlatdar & Agricultural Lands Tribunal, Choryasi under Section 84C of the Tenancy Act in Tenancy Case No.246 of 1984.
The application is this disposed of with the above directions.
