Challenge is to an order dated 5.10.2020 passed by the Special Land Acquisition Officer (Joint Organization), Azamgarh, whereby, the claim of the petitioner for compensation in lieu of the alleged acquisition of 0.0316 hectare of Plot No. 301 situated at Mauza Rohua Mustafabad, Pargana Beladaulatabad, Tehsil Lalganj, District Azamgarh for construction of National Highway No. 233 has been rejected.
It is contended that out of total area 2.565 hectare of Plot No. 301, an area of 4944 sq. mt. was acquired wherein petitioner had share over 0.1236 hectare wherefrom 0.0920 hectare was sold to Pradeep Singh son of Shambhu Nath, and remaining 0.0316 hectare remained with the petitioner. It is urged that the said piece of land though acquired, however, no compensation in lieu thereof is paid.
The Authority concern, however, after analyzing the entire facts and the documents on record found that the petitioner being in possession of the portion of Gata No. 301 situated behind the land of Pradeep Singh was not acquired:-

Petitioner having failed to establish through cogent material evidence that the findings arrived at by the Authority suffers from perversity, no interference is caused.
Consequently, petition fails and is dismissed.
