Learned counsel for the parties do not dispute that the issue sought to be raised in this writ petition is squarely covered by several decisions of this Court including Writ C No. 11474 of 2018 (Gayatri Build Associates Pvt. Ltd. vs. State of U.P. and others) filed by present petitioner, which came to be disposed of on 5.7.2019 with liberty to the respondent concerned to invoke arbitration as per Clause 7 of the agreement.
Learned counsel for the parties submits that they would have no grievance if the present petition is also disposed of on the terms and conditions as contained in the order dated 5.7.2019.
The writ petition is disposed of on the terms and conditions as contained in the order passed in Writ C No. 11474 of 2018 dated 5.7.2019 and the said order would be a part of this order. Consequently recovery certificate dated 5.9.2020 is quashed as was quashed in the leading petition.
