The petitioner claims herself to be a senior citizen and an old parent. She is apprehending danger from her son Deepak Shukla, respondent No.4. It is alleged that he is not allowing the petitioner to enter in her own house and that her life and property is in danger at his end.
In view of the above background, the petitioner has approached the District Magistrate as well as the S.S.P. of the district under Rule 21/22 of the Rules framed in the Maintenance and Welfare of Parents and Senior Citizen Act, 2007 to provide protection to her life and property. It is said that none of the authorities have taken any action on the said application of the petitioner.
Since the Section 22(2) of the Act contemplates for an action plan for providing protection to life and property of senior citizen and Rule 21 provides the duties and powers to the District Magistrate, in that regard, we direct the District Magistrate to consider the application of the petitioner dated 22.05.2018 filed as annexure-3 to the petition in accordance with law most expeditiously, if possible, within a period of six weeks and to ensure that if petitioner is a senior citizen and is entitled to the benefits under the Act, her life and property are duly protected.
