Heard learned counsel for the petitioner, learned Standing Counsel representing respondent nos.1 & 2 and Sri P. R. Chaubey, learned counsel for respondent no.3-bank.
The submission of the learned counsel for the petitioner is that there were dues of Rs.8,45023/- against the petitioner's husband. The respondent-bank gave notice through Legal Service Authority directing her husband to deposit an amount of Rs.3,22,807/- as full and final settlement of the loan by 08.12.2018. However, the husband of the petitioner died on 25.11.2018 i.e., prior to the date fixed for his appearance on 08.12.2018.
The grievance of the petitioner is that the original borrower, her husband, has died and she is not in a position to make the payment of the loan due against respondent-bank in lump sum. She states that she needs some time for repayment of loan. She has pointed out on 09.12.2018 she has deposited Rs.10,000/- before Permanent Lok Adalat.
This writ petition is disposed of leaving it open for the petitioner to make an appropriate application for settlement of the dues before the respondent-bank, which shall be considered by the respondent-bank and appropriate orders shall be passed within two months from the date of production of a certified copy of this order in accordance with banking rules and circulars..
