Heard learned counsel for the petitioner and learned Standing Counsel.
The claim of the petitioner under the Mukhyamantri Kisan Evam Sarv Hit Bima Yojna has not been accepted by the Insurance Company by the impugned order dated 15.07.2019 on the ground that it has been preferred with the delay.
The scheme provides that ordinarily the claim shall be preferred within four months of the death and in special cases, the District Magistrate would have the power to condon the delay if the claim is within one year.
In view of the aforesaid facts and circumstances, we dispose of the writ petition with liberty to the petitioner to approach the District Level Committee added by the District Magistrate for condoning the delay in filing the claim. In case any such application is filed within a period of two weeks from today, the said Committee will consider it and pass appropriate orders in accordance with law most expeditiously, preferably within a period of six weeks.
