HONOURABLE SRI JUSTICE S.RAVI KUMAR CRIMINAL PETITION No.2011 OF 2012 ORDER:
This petition is filed to quash the proceedings in C.C.No.2285 of 2010 on the file of IX Additional Chief Metropolitan Magistrate, Hyderabad.
2. When this matter is called, request is made to pass over and it is passed over and again it is called at 2- 15 P.M. Learned advocate representing Sri P.Sivakumar, requested for adjournment on the ground that counsel left the court due to personal inconvenience.
3. Other side opposed for granting adjournment and represented that as there is no stay, trial has commenced and proceedings are going on in the court below.
4. Since the trial of C.C.No.2285 of 2010 is in progress as per the version of the complainant, I am of the view that at this stage, the correctness of the charge sheet allegations for which trial has already been commenced cannot be decided and petitioners can raise all these objections before the trial court and the learned Magistrate shall consider the grounds urged by the petitioners without being influenced by the disposal of this petition as well as the observation of this court.
5. With this observation, this Criminal Petition is dismissed.
6. As a sequel to the disposal of this Criminal petition, the Miscellaneous Petitions, if any, pending, shall stand dismissed.
