THE HON’BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON’BLE SRI JUSTICE SANJAY KUMAR PUBLIC INTEREST LITIGATION No. 126 of 2014 ORDER: (Per the Hon’ble The Chief Justice Sri Kalyan Jyoti Sengupta) After arguing the matter for about half-an-hour, learned counsel for the petitioner submits that he will approach the appropriate civil Court in view of the factual dispute raised in this matter.
We permit him to withdraw this writ petition with liberty to file fresh action before the appropriate Court, if so advised.
The writ petition is accordingly dismissed as being withdrawn. However, this order of withdrawal is with a condition that the petitioner shall make payment of costs assessed at Rs.500/- (Rupees Five hundred only) to be paid to the High Court Legal Services Committee within fortnight from the date of receipt of a copy of this order, failing which, the leave granted by this Court to initiate further action will stand recalled. The costs have been awarded because of wastage of Court’s time unnecessarily. The litigant should know that the Court’s time is not meant for his own, but it is for the just and proper cause and is a public time.
Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
