Heard learned counsel for the applicant and learned A.G.A.
This application has been filed with a prayer to quash the chargesheet of case crime No. 218-A of 2010 under sections 323, 504 IPC, P.S. Tarun, District Faizabad pending in the court of learned I-A.C.J.M. Faizabad in criminal case No. 2033 of 2010.
From the perusal of the record it appears that on the basis of material collected by the I.O. prima facie offence is made out against the applicant. There is no illegality in submitting the chargesheet and in t aking the cognizance by learned Magistrate concerned. The prayer for quashing the same is refused.
However, considering the nature of allegation, it is directed that in case applicants move the applicant appear before the court concerned within 30 days from today and applies for bail, the same shall be heard and disposed of on the same day. thereafter in case the applicant moves a discharged application before the court concerned, the same shall also be heard and disposed of under the provisions of law.
With this direction, this application is finally disposed of.
