Sri Manoj Nigam, learned counsel for respondents no. 2, 3 and 4 has filed One Time Samadhan Scheme is taken on record.
Heard learned counsel for the petitioner, Sri Manoj Nigam, learned counsel for respondent nos. 2 to 4 and learned Standing Counsel for the State.
The petitioner has taken loan of Rs. 1,01,600/- for establishing dairy farm. However, due to unavoidable circumstances, the petitioner could not pay the loan and consequently, the impugned sale proceedings initiated against the petitioner.
It is informed by learned counsel for the respondents that the bank has launched "One Time Samadhan Yojana-2018" and last date for availing benefit of the said scheme is 30.06.2019. The petitioner may approach the bank, if he desire to avail benefit of One Time Samadhan Scheme.
Learned counsel for the petitioner submits that the petitioner is ready and willing to avail One Time Samadhan Scheme-2018 and for this he will approach concern authority by filing application within a period of 10 days from today. In case the petitioner submits any such application, the bank authority will consider the petitioner's case sympathetically and if the authority find that the petitioner is eligible for the benefit of the said scheme, the same shall be extended to him.
Till disposal of the application of the petitioner for availing benefit under One Time Samadhan Yojna (OTS)-2018, the auction of the property of the petitioner shall remain stayed.
With the above observations the writ petition is disposed off.
