Gaya Deen S/O Muddu vs District Magistrate, Sultanpur & ...

High Court Of Judicature at Allahabad|29 January, 2010

JUDGMENT / ORDER

Hon'ble Dr. Satish Chandra,J.
Heard learned counsel for the petitioner and the learned Standing Counsel appearing for State respondents.
The petitioner has preferred this writ petition with the following relief:-
"1.Issue a writ, order or direction in the nature of Mandamus directing to the Opposite-parties more specifically to the O.P.No. 1 and 7 to provide the police force for construction of the 'Kharanja' way to comply the Administrative order keeping in view to maintain the law and order."
The petitioner is a member of Nirman Samiti and is engaged in constructing building and providing employment to the rural unemployed persons under the Rural Development Scheme. It is alleged that some miscreants in the village are not allowing the Kharanja (Kutchcha road made of bricks) to be laid and dismantled the road every time when it is constructed. We are of the opinion that the relief may be considered by the District Magistrate at the first instance. This Court does not ordinarily look into such trivial issues.
The writ petition is dismissed.
