Petitioner is aggrieved with Ext.P5 order which directed the petitioner to pay the amounts assessed for maintaining the appeal under the Building and other Construction Workers Welfare Cess Act, 1996. Admittedly, the deposit is a pre-condition for maintaining an appeal as per the statute. In such circumstances, this Court cannot interfere in Ext.P5. Since the petitioner pleads and considering the impecunious circumstances, the petitioner is granted the facility to pay the amount in three instalments, as per the demand in the order, which is subject of appeal before the authority. Petitioner shall pay the amounts on or before 18.3.2015, in which event the appeal shall be considered on merits. If no deposit is made, then, definitely, the appeal would be rejected. No coercive steps shall be taken in the meanwhile, nor the appeal rejected.
Writ petition is disposed off.
