JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE PARESH UPADHYAY) Rule.
Mr.Pandya, learned APP waives service of notice of Rule.
By way of this application, the applicant - convict has prayed that he be enlarged on temporary bail, since his wife, who is present in the Court, is suffering from ailment, for which surgery as well as managing finance is required. Along with the application, medical certificate is annexed.
From the jail remarks, it transpires that in the year 2008, the applicant
- convict, while he was on furlough, had absconded. However, in the year 2011, he was enlarged on temporary bail and he has surrendered before the jail authority in time.
Considering the totality of the facts, it is ordered that applicant - convict shall be enlarged on temporary bail for a period of two weeks from the date of his actual release on personal bond of Rs.5,000/- (Rupees five thousand only) with one surety of like amount, with the further direction that the applicant - convict shall surrender before the concerned jail authority on expiry of the bail period granted by this Court.
The application is allowed to the aforesaid extent. Rule made absolute accordingly. Direct service is permitted.
