Heard Sri Suresh Pratap Singh, learned counsel for the petitioners, learned Standing Counsel for the State and perused the record.
The order which is proposed to be passed, in the considered opinion of the Court, it is not necessary to issue notice to the respondent Nos. 2 to 6 who are already party in the case pending before the Nayab Tehsildar Naugarh, District- Siddharthnagar.
Learned counsel for the petitioners submits that the petitioners have preferred a case No.- 637/11/322/07/159/02/166/02 before the Nayab Tehsildar Naugarh, Siddharthnagar for mutation under Section 34 of Land Revenue Act, 2001.
Learned Standing Counsel does not have any objection if any direction is issued for disposal of the case on merits after putting notice to the contesting respondents.
In view of the above, the writ petition is disposed of with the direction to the Nayab Tehsildar, Naugarh, District- Siddharthnagar to dispose of the pending case of the petitioners on merits as expeditiously as possible preferably within a period of three months from the date of production of certified copy of this order.
However, it is provided that the Nayab Tehsildar, Naugarh, Siddharthnagar shall ensure that all the contesting respondents of the case shall be properly served with the notice and shall be given proper opportunity of hearing before any order is passed.
