Sri S.K. Khare, learned counsel for the petitioner submits that vide order dated 23.05.2006 passed in the writ petition No. 1896 (S/B) of 2004, this Court has extended the benefit of the judgment dated 21.07.1993 passed in writ petition No. 8148 of 1990 along with the other matters.
He further submits that after the dismissal of the SLP in both the above mentioned writ petitions, the orders have become final. The petitioner has been restored in the service in the year 2010 and getting regular salary but no back-wages have been paid.
He also submits that the case for the petitioner for regularization has not been considered as per the direction given by the Court in the order dated 21.07.1993.
After hearing the learned counsel, it appears that in the order dated 21.07.1993, it was clearly mentioned that the petitioner will not be entitled for the back-wages. However, in the order the opposite party was further directed to consider the case of the petitioner for regularization of the services. But the said regularization has not been considered by the opposite party till date.
Therefore, I direct the opposite party to consider the case of the petitioner for regularization within a period of two weeks towards the compliance of the order passed by this Court, failing which, he will have to appear before this Court on the next date of listing.
Learned Standing Counsel shall ensure the compliance of this order.
