Heard learned counsel for the petitioners.
None appears on behalf of the respondents although name of Shri Shamim Ahmed has been shown as appearing on behalf of Zila Panchayat.
It is the case of the petitioner that when this writ petition was filed the petitioner has prayed for a writ in the nature of mandamus to the respondents to regularize the services of the petitioner. However, because of cut off date under the Regularization Rules being fixed as '1996', the petitioners could not be considered for regularization. Now Government Order has been issued on 24.02.2016, which is applicable to Public Sector Undertakings and Local Bodies also, has fixed the amended cut of date as 31.12.2001. He has brought a copy of the Government Order dated 24.02.2016 for perusal of the Court. He prays that this writ petition be disposed off with a direction to the respondent no. 3 to consider the case of the petitioners for regularization as now they fall within the cut off date, as amended.
This writ petition is disposed off with a direction to the respondent no. 3 (Apar Mukhya Adhikari, Zila Panchayat, Budaun) to consider the grievance of the petitioner and pass appropriate orders regarding their regularization, in case they fall within the zone of consideration of the Government Order dated 24.02.2016, within a period of three months from today.
