Heard learned counsel for the petitioner and learned Standing Counsel for the State-respondents.
This writ petition has been filed seeking the following among other relief:-
"A. Issue a writ order or direction in the nature of mandamus commanding/ directing the Settlement Officer Consolidation, Gorakhpur i.e. respondent no. 1 to decide the Appeal no.
156 (Vishwanath Vs. Shirraji) under section 11 (1) of the Consolidation of holdings Act, pending before the Settlement officer Consolidation, Gorakhpur, within stipulated period as fixed by this Hon'ble Court. "
The grievance of the petitioner in this writ petition is that the appeal had been preferred in the year 1995 but has not been disposed of, till date.
Under the circumstances, this writ petition is disposed of with the direction to the respondent no. 1, Settlement Officer Consolidation to decide the appeal (156) positively within a period of four months from the date of a certified copy of this order filed before him.
In case, necessity arises the Settlement Officer Consolidation may also proceed to hear the matter on a day-to-day basis so as to passed final orders within the period specified above.
