Heard Sri Sunil Vashisth, counsel for the revisionists and learned AGA.
The instant revision has been filed against the impugned order dated 9.1.2018 passed by Additional Session Judge/F.T.C., court no. 52, Kanpur Nagar in S.T. No. 594 of 2014 as well as case crime no. 224 of 2014, u/s 147, 302, 149, 504, 506 IPC, P.S. Maharajpur, District Kanpur Nagar whereby revisionist has been summoned to face trial.
I am not in agreement with the submissions raised by counsel for the revisionist that apart from the statement of the witnesses recorded during trial, the trial court has also relied upon the statement of witnesses recorded during investigation. The trial court has not committed any illegality in the order summoning the revisionist u/s 319 Cr.P.C.
The application lacks merit and is accordingly dismissed.
However, it is directed that if the revisionist appears and surrenders before the court below and applies for bail, his prayer for bail shall be considered and decided expeditiously in accordance with law.
