The allegation of the petitioner is that initially after retirement, petitioner was paid provisional pension however the final pension has not been paid to the petitioner infact no pension has been paid to the petitioner with effect from May, 2020.
This Court called upon instructions.
Learned Standing Counsel on instructions states that on account of improper fixation of pension, the objections have been received that excess pension has been granted to the petitioner and in this regard several letters have been written to the petitioner to kindly come and explain the discrepancy that has arisen, however, the petitioner has not appeared before the executive engineer.
The petitioner states that he has already filed reply and the stand taken by the respondents is not justified.
As the decision is yet to be taken, this Court deems it fit to direct that petitioner shall appear before Executive Engineer, respondent no. 2 on 20.8.2021 at 12.00 noon. Respondent no. 2 shall hear the petitioner and pass orders with regard to payment of pension to the petitioner within two weeks' thereafter.
Learned Standing Counsel shall place the order passed by respondent no. 2 as directed above before this Court on the next date.
