Heard learned counsel for the applicant and Km Meena learned A. G. A. for the State.
The present anticipatory bail application has been filed by the applicant in Case Crime No.117 of 2019 u/s 147, 148, 149, 307 IPC PS Pilkhua District Hapur.
I have perused the FIR as well as the order by means of which the anticipatory bail application has been rejected by the court below which is a very elaborate and speaking order.
Km Meena, learned AGA has opposed the prayer for anticipatory bail with the contention that though all the injured have given their affidavit and the first informant has also given an affidavit denying the participation of the applicant in the alleged crime, nevertheless the fact remains that at this stage the veracity of those affidavits cannot be gone into by this Court. It has not been disputed that a number of persons have received a number of injuries.
After hearing learned counsel for the parties and after perusing the impugned FIR and also looking to the seriousness of the allegation as made in the FIR, gravity of offence and the severity of punishment, no case for grant of anticipatory bail is made out.
Accordingly, the application for anticipatory bail is rejected.
