Heard learned counsel for the applicant and learned A.G.A for the State.
This application under Section 482 Cr.P.C. has been filed to expedite the proceedings of Case No.4163/9 of 2014, arising out of Case Crime No.364 of 2014, under Sections 392, 411 and 120B I.P.C., Police Station- Khatauli , District- Muzaffar Nagar, pending in the court of Learned Chief Judicial Magistrate, Muzaffar Nagar.
Learned counsel for the applicant stated that applicant who is the accused, is a student of M.B.A. course who has been falsely implicated in the case. At present, charges have been framed on 8.3.2016, and the trial is lying stalled because the witnesses are not appearing. It is submitted that if the trial stretches for an unduly long period, the career of the applicant may be marred.
Considering the fact that the trial has remained pending for very long and without expressing any opinion on the merits of the case, this application is finally disposed of with a direction to the court below to decide the aforesaid case in accordance with law, without granting any unnecessary or long adjournments as expeditiously as possible, preferably within a period of two years from the date of production of a certified copy of this order, if there is no other legal impediment.
