1. The petition seeks issuance of a writ in the nature of Habeas Corpus with the plea that the petitioner has been taken in illegal custody by respondent no.6 on 21.01.2016. Despite repeated applications/representations, the detenue has not been released.
2. Learned counsel appearing for the State, on the basis of instructions has informed the Court that the petitioner is an accused in Case Crime No.515 of 2015, under Section 394 I.P.C., P.S. Kotwali Akbarpur, District Ambedkar Nagar. In the Course of investigation of the said case the petitioner has been arrested.
3. Learned counsel for the petitioner states that the petitioner was taken in custody on 21.01.2016. Custody of the petitioner was illegal for seven days.
4. Considering the facts that the petitioner is involved in a criminal case as an accused and has been formally arrested, no ground for interference at this stage is made out in a writ filed under Habeas Corpus jurisdiction. The petitioner may avail appropriate remedy if he has a genuine cause.
Petition is disposed of.
